Klade is a social fitness marketplace where clients can schedule and workout with hosts. By accessing or using our app, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, you should not use our app.

Definitions

  • App: Refers to Klade, the social fitness marketplace.
  • User: Any individual who accesses or uses the app.
  • Client: A user who schedules and participates in workout sessions.
  • Host: A user who hosts and leads workout sessions.
  • Services: Any functionality provided by the app, including but not limited to scheduling, hosting, and participating in workout sessions.

User Accounts

  • Account Creation: Users must create an account to use certain features of the app. You agree to provide accurate and complete information when creating an account.
  • Account Security: You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account.
  • Account Suspension and Termination: We reserve the right to suspend or terminate your account at our discretion, without prior notice, for any reason, including but not limited to violation of these Terms and Conditions or engagement in any prohibited conduct.

Eligibility

  • Age Requirement: You must be at least 18 years old to use our app.
  • Compliance: You agree to comply with all applicable laws and regulations when using our app.

Use of the App

License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the app for personal use.

  • You agree not to use the app for any illegal purpose.
  • You agree not to harass, abuse, or harm another person.
  • You agree not to upload, message, or share any content that is offensive, defamatory, or violates any third-party rights.
  • You agree not to interfere with the operation of the app or the servers or networks connected to the app.

Booking and Payment

  • Scheduling: Clients can schedule workout sessions with hosts through the app.
  • Payments: All payments for sessions are processed through our third-party payment provider, Stripe. By using our app, you agree to comply with Stripe’s terms and conditions.
  • Cancellations and Refunds: Cancellation and refund policies for workout sessions are determined by each host. Clients should review these policies before booking a session.

Host Responsibilities

  • Accuracy: Hosts must provide accurate information about their workout sessions.
  • Compliance: Hosts are responsible for ensuring that their sessions comply with all applicable laws and regulations.
  • Insurance: Hosts are encouraged to have appropriate insurance coverage for the services they provide.

Disclaimers

  • No Warranty: The app is provided "as is" and "as available" without any warranties of any kind, either express or implied.
  • Health Disclaimer: Klade does not provide medical advice. Users should consult with their healthcare provider before starting any fitness program.

Limitation of Liability

  • Indirect Damages: Klade will not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Maximum Liability: The maximum liability of Klade to any user for any claims arising out of or relating to the app is limited to the amount paid by the user to Klade in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold Klade harmless from any claims, damages, losses, or expenses (including legal fees) arising out of or related to your use of the app, your violation of these terms, or your violation of any rights of a third party.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify users of any changes by posting the updated terms on our app. Your continued use of the app after any such changes constitutes your acceptance of the new terms.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of United States/California, without regard to its conflict of law principles.
